Belarus intends to more precisely regulate the use of video surveillance and audio recording when processing personal data. The corresponding draft law has already been submitted to the government. This was announced by Andrei Gaev, Director of the National Personal Data Protection Center, as reported by BelTA.
According to the official, current legislation regulates these issues only partially. The use of video recordings in the sphere of public safety already has clear legal frameworks, but in other situations, questions arise as to who, when, and on what grounds has the right to record.
The project envisages a ban on video surveillance in places where a person's private life is affected. These include, for example, premises for eating, changing clothes, and performing other daily personal matters. In such cases, video surveillance will be considered excessive.
Separate norms are proposed to be introduced for audio recordings as well. For example, recording a conversation will be allowed when contacting emergency services and other organizations, if such a possibility is provided for by law. At the same time, people must be informed in advance about audio recording.
Another part of the draft law concerns decisions made with the help of artificial intelligence and fully automated processing of personal data. This will require a corresponding legal norm or other legal basis.
Andrei Gaev emphasized that even with the development of artificial intelligence and big data technologies, a person must remain a participant in the process of making important decisions. If a decision is made by a system, for example, when providing medical assistance or hiring, a person must have the opportunity to object and influence the outcome.
