Who should pay the debt left by the former apartment owner?
«The former owner of the apartment left a debt of 340 rubles (for two years) to the chairman of the cooperative. Does the chairman of the cooperative have the right to transfer this debt to me?» — a woman asked.
Galina Komarovskaya, a lawyer from the Minsk City Bar Association, explained:
«The chairman of the cooperative not only has the right, but is also obliged to collect the debt from you. Because you are obligated to the cooperative — as the new owner».
What to do in this situation?
Pay the cooperative. If you dispute the debt, the chairman will apply for an enforcement order from a notary or to court. And then, in addition to 340 rubles, you will also have to pay court costs (up to a thousand rubles).
Recover money from the seller. After you pay the debt to the cooperative, you have the right to recover this amount from the person who sold you the apartment and did not warn you about the existence of the debt.
